CPSC Rejects Exclusion, Offers Stay of Enforcement

As expected, the CPSC today denied the industry’s petition for an exclusion from the lead limits created by the CPSIA. Instead, the commission offered an alternative “solution”: a two-year conditional stay of enforcement regarding youth vehicles and their replacement parts. But in doubt is whether such a stay would remove all liabilities faced by dealers and OEMs.

Thomas Moore, one commissioner of the two-person CPSC, said in a statement that he supports the stay proposed two weeks ago by his colleague, acting Chairman Nancy Nord. He does so for the same safety reasons.

The delay will go into effect, Moore said, sometime after his staff spells out the stay's conditions in writing. The staff’s due date is April 24. “I anticipate that the commission will vote to approve it in the near future,” he said.

According to staff directions issued by the commission, the stay will end on May 1, 2011, but manufacturers will be able to file for extensions.

Nord issued her own statement saying that she supports Moore’s decision, and that she hopes the state attorneys general will follow the commission’s lead.

Even after the CPSC issues a stay of enforcement, state officials could enforce the law.

Would dealers be safe if both the CPSC and their state officials decide to stay enforcement? Perhaps, though Dealernews hasn’t been able to obtain a legal opinion.

Paul Vitrano, general counsel for the MIC and SVIA, didn’t seem overly impressed by Nord’s stay announcement two weeks ago. At the time he said on his Twitter blog that he was “analyzing the value of the stay, if any.”

In a statement issued by the MIC in response to today’s news, Vitrano stated, “With today’s vote, it is now obvious that the only permanent solution is for Congress to end the ban once and for all.” Two bills now being debated, S. 608 and H.R. 1587, could eventually end the ban.

Some industry analysts had doubted whether Moore, who has publicly supported the CPSIA, would agree to the stay. Moore himself seems surprised by the decision, writing, “It is ironic that I am defending vehicles that I consider to be dangerous for children under 12 to ride and which contain accessible parts with excess levels of lead. However, the alternatives appear to be more dangerous.”

Moore noted that an ATV maker has told the commission that it’s removing the speed limiters from its Y-6 ant Y-10 quads and relabeling them Y-12. “Thus the vehicles that are more accurately sized for younger children will be less safe because of their ability to attain higher speeds,” he said.

Moore’s statement provided guidance on how the stay of enforcement will read. He said the stay will apply to vehicles made to date and through the expiration date of the stay. Repairs and replacement parts will be allowed as long as the lead content of the parts is comparable to that of the originals.

During the stay, Moore stated, manufacturers must work, “on a reasonable schedule,” to design youth vehicles that meet the lead limits as closely as possible. OEMs must provide concrete data to justify any continued use of excess lead in accessible components. “The evidence considered is strictly limited to technological feasibility, not on the higher cost of a viable substitute,” he said.

Government continues to run our lives. Unless a child places the parts of these ATVs and motorcycles in their mouths I see no reason for this ban in the first place. It was not thought out clearly and this is government at it's finest affecting business people and consumers alike. I don't see them putting a ban on cigarettes which are harmful to everyone's health! Oh wait, that would mean they wouldn't be collecting giant amounts of tax on cigarettes! What are they thinking?

Any time you hear a politician say "we must act NOW" Tell everybody to take a deep breath, slow down, and READ THE BILL BEFORE SIGNING IT. This is the equivalent of banning all products that emit carbon monoxide because it is dangerous to breath but for forgetting that planes, trains, and automobiles emit said substance. Reasonable, common sense legislation is what is needed here, not this ridiculousness. Ironically a Senator from my state of Arkansas (a very small state with a very BIG ATV market) wrote the original bill.

Like most bills it was written with good intentions "lead is bad for kids so ban lead products from kids" but now yet again, we have all seen the byproduct of such "rushed" and "irresponsible" lawmaking. You would think Senator Pryor, D-Ark., after seeing the error of his ways would be leading the charge to reverse this maddening legislation but he is not. House Rep. Denny Rehberg, R-Mont. and Jon Tester, D-Mont. have introduced bills in the House and Senate that would exempt youth dirt bikes and ATV's. You might want to contact Mark Pryor and inquire why he is not the one leading the charge to reverse this ridiculous bill as he is the one who wrote it. Let Senator Pryor know if you have seen the disturbing trend of adults attempting to bypass the law and buy larger than recommended machines for their children. Let him know if you have customers who wish to service their existing youth ATV's and buy safety gear, including helmets but you are forced to tell them its AGAINST THE LAW and describe the looks on their faces to him. Describe to him the shoddy do it yourself safety repairs you have seen done either by Mothers or Fathers with good intentions, just not certified to service/fix brakes and other critical safety components. Or safety related repairs done by some other unscrupulous "shade tree mechanics" with sub par, unsafe, aftermarket parts who sorely lack the certification or credentials to perform such repairs. Let him know before the headlines show children in wheelchairs or in a grave on the evening news and front pages of newspapers with his name attached as the responsible (irresponsible?) party. Yet another lawmaker who knew or should have known the negative byproducts of RUSHED, UNREAD, LEGISLATION. Ask Senator Pryor to SPECIFICALLY EXPLAIN WHY HE IS NOT LEADING THE CHARGE TO REVERSE THIS INSANE BILL. Kindly ask him to not send out the "kneejerk canned" response letter he has prepared for people emailing him about this subject. The canned form letter basically explains that lead is bad etc. and he is "monitoring" the C.S.P.S.I.A daily "hoping for change". Once again ask him to explain why two politicians from MONTANA are leading the charge to reverse this idiocy. GOOD LUCK TO YOU ALL AND DO NOT QUIT CALLING AND WRITING LETTERS. WE WILL PREVAIL!!!! Ths government wants to help the economy out of one side of their mouth, yet on the other side their decisions are affecting thousands of people who depend on this industry to feed their families. Like the poster below, unless a child puts the parts in their mouth and digests them, I don't see a problem. In all the years I have sold parts, I have yet to see anyone eat an engine case or any other part. If our government wants to help the economy and provide jobs, lift the ban NOW!

LAWS THAT ARE WRITTEN WITHIN REASON SHOULD NOT BE INTERPRETED TO EXTREMES. THE LAW WAS DESIGNED FOR CHILDREN, PROBABLY TOO YOUNG TO KNOW ANY BETTER THAN TO PUT THINGS IN THEIR MOUTH.IF WE WANT TO GO TO EXTREMES, WE SHOULD BAN THE AUTOMOBILE, WHICH HAS A BATTERY THAT ISN'T EASILY ACCESSIBLE, RADIATORS THAT HAVE LEAD IN THE SOLDER AND THE LIST GOES ON. I GUESS ANY LAW THAT CAN CREATE A FINE IS ACCEPTABLE
